Statute of Limitations

A statute of limitations is a law restricting the amount of time a person has available to file a claim that differs depending on the state. In claims for the types of injuries caused by such matters as products liability, the victim cannot file suit more than six years from the date of the initial purchase of the product.

MEDICAL MALPRACTICE
Claims against medical care providers in North Carolina must be filed within three years of the injury or two years after the plaintiff discovers the injury, and never can more than four years elapse. In cases of an accidental object insertion, a victim has one year from the incident or one year from the discovery of the insertion to file, but never more than 10 years.

WRONGFUL DEATH
In a majority of times in North Carolina, a wrongful death lawsuit must be filed within two years of the victim\'s death.

SPECIAL RULES FOR MINORS AND OTHER ISSUES
Except in lawsuits regarding medical malpractice or wrongful death, the time constriction in North Carolina elapses three years from the minor s 18th birthday.
